Terms of Use

CarHyve is an online venue where private individuals list their own vehicles for sale and buyers contact them. We are not a dealer, broker, auctioneer or agent, and we are not a party to any sale.

We don't own, inspect, finance, insure, title, register, deliver or guarantee any vehicle, and we don't handle payments. Any agreement to buy or sell is made directly between buyer and seller, who are solely responsible for it.

You must be at least 18 years old and able to enter into a binding contract to create an account.

Keep your password (or the Google account you sign in with) secure and your contact details accurate. You're responsible for everything done through your account. Tell us right away if you think someone else is using it.

One person per account. Don't create accounts for someone else, or to get around a suspension or our limits.

CarHyve is for private-party sales only. By listing a vehicle, you confirm that:

• you are an individual selling a vehicle you own or are legally authorized to sell, not a dealer, broker or business, and you aren't selling vehicles as a business in a way that requires a dealer license in your state (sometimes called curbstoning);
• the vehicle is located in the United States and you can transfer its title;
• the VIN, mileage, title status (including any salvage, rebuilt or lien status), accident history and every other detail you provide are true and complete to the best of your knowledge;
• the photos show the actual vehicle you're selling;
• the price is the real asking price, with no hidden fees.

Keep your listing up to date and mark it as sold or remove it once the vehicle is no longer available. You are responsible for complying with all laws that apply to the sale, including title transfer, odometer disclosure, emissions and safety requirements, and taxes.

Listings are written by sellers. We don't verify them, and a listing can be wrong, out of date or fraudulent. Before you pay anything:

• see the vehicle in person and test-drive it, ideally with an independent mechanic's inspection;
• check that the VIN on the vehicle and on the title match the listing, and that the title is in the seller's name;
• get an independent vehicle history report;
• never wire money, pay with gift cards or cryptocurrency, or send a deposit for a vehicle you haven't seen.

Some listings show vehicle history data from third-party providers, or a report link supplied by the seller. This information comes from sources we don't control. It can be incomplete or contain errors, and a vehicle can have damage or problems that no report shows. It is provided for information only and is not a warranty or an inspection.

When you contact a seller, we send your name, email address, optional phone number and message to the seller, who can reply to you directly. Use messages only to discuss the vehicle. Don't send spam, advertising, threats, harassment or requests for payment or personal financial information.

You may not:

• post false, misleading or fraudulent listings, or listings for vehicles you can't legally sell;
• post content that is illegal, offensive, discriminatory, or that infringes someone else's rights;
• use the Service for scams, phishing, money laundering or any other illegal purpose;
• collect other users' personal information, or scrape, copy or resell listings or other data from the Service without our written permission;
• interfere with the Service, bypass rate limits or security measures, or access it through automated means other than public search engines;
• impersonate anyone or misrepresent your relationship with anyone.

You keep ownership of the listings, photos and messages you submit. You grant CarHyve a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display and adapt that content (for example, resizing photos) to operate and promote the Service, for as long as it remains on the Service and for a reasonable time afterwards for backups and legal records.

You confirm that you have the rights to everything you submit, including the photos.

Anyone signed in can report a listing with the "Report this listing" link. We may review, edit, hide or remove any listing or content, and suspend or close any account, at our discretion and without notice, including when we suspect fraud or a breach of these Terms. We have no obligation to monitor the Service.

You can stop using the Service at any time. To close your account and delete your data, contact us at support@web.carhyve.cloud.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T WARRANT ANY VEHICLE, LISTING, USER OR VEHICLE HISTORY DATA, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY LAW, CARHYVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM A TRANSACTION OR DISPUTE BETWEEN USERS, OR FROM ANY VEHICLE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100). SOME STATES DON'T ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

You agree to indemnify CarHyve against claims arising from your listings, your content, your transactions with other users or your breach of these Terms.

We may update these Terms. If a change is material, we'll give notice on the Service or by email before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
